This module is part of the post qualification framework and is ideally suited for health and social care professionals who are seeking to explore legal and ethical dimensions in health and social care as part of their ongoing professional development. This module will enable professionals to gain a critical understanding and applied appreciation of health-related law and ethics, whilst exploring its application and affect on practice. An overview of contemporary legal thinking will be offered. The module will also explore the values held by professionals and society, as the language of rights and responsibilities increasingly influences practice. This module aims to raise your overall professional capacity and help you to engage more effectively with moral dilemmas in practice. At the end of this module students will be better equipped to analyse evidence, articulate complex arguments in written and verbal forms, and defend professional decision making.

Aims of the course

To enable professionals to develop a critical appreciation of relevant ethico-legal skills and knowledge.

Learning Outcomes

  1. Articulate moral argument based on professional judgements and critical reasoning.
  2. Evaluate the application of legal decision making in health and social care practice.
  3. Critically apply ethical theory to moral dilemmas in practice.

Module Overview

This module will provide students with an overview of the English Legal system, including legal aspects of consent, negligence, confidentiality and autonomy. It will consider traditional and contemporary ethical theory, moral decision making, articulating moral arguments, critiquing arguments, and exploring values in ethical decision-making. The module will address current issues arising from contemporary and emerging NHS policies, Clinical Governance, and evidence based practice.
